Terms of Use

These Terms of Use govern access to and use of PleaseScanMenu by restaurant operators, cafe owners, guests, and other visitors. By using the service, you agree to these terms together with our Privacy Policy, Cookie Policy, and any applicable notices shown in the product.

1. Service Nature & Disclaimers

PleaseScanMenu is a software platform for digital menus, QR access, lightweight ordering flows, guest-service requests, and restaurant management tools. We provide technology infrastructure only. We are not the restaurant, food provider, merchant of record, courier, payment processor, or fulfillment agent.

  • Menu content: restaurants are solely responsible for menu accuracy, price accuracy, allergen details, translations, availability, branch details, and any other content shown to guests.
  • Food and service quality: we are not responsible for preparation, hygiene, food safety, ingredient quality, dietary suitability, delivery, table service, or in-venue operations.
  • Operational decisions: all decisions about accepting orders, refusing service, editing menu content, or responding to guests belong to the restaurant operator.

2. Ordering & Payments

Ordering flows in PleaseScanMenu are communication and operational tools between guests and restaurants. Unless expressly stated otherwise in a separate agreement, PleaseScanMenu does not process guest payments, guarantee order fulfillment, validate stock in real time, or assume liability for failed, delayed, incorrect, or disputed orders.

3. QR Code Safety and Link Verification

Guests should always verify that a scanned QR code leads to an official PleaseScanMenu domain or another domain explicitly controlled by the restaurant. Printed QR materials may be damaged, replaced, covered, or manipulated by third parties without our knowledge.

  • We do not guarantee the authenticity of every physical QR code displayed in the real world.
  • Users should confirm they are on the correct website before submitting any order, request, or personal information.
  • Restaurants are responsible for reviewing their own printed QR materials and in-venue signage.

4. Camera Access & Usage

Camera Permission: We request access to your device camera solely for the purpose of scanning QR codes to display restaurant menus.

No Image Storage or Recording: We do not capture, store, transmit, or record any images or video from your camera. All QR code scanning is performed locally within your browser.

Local Processing: Camera input is processed in real-time on your device. No visual data is sent to our servers or any third parties during the scanning process.

Temporary Access: Camera access is only active while you are using the scanning feature and is immediately terminated once scanning is complete or you leave the page.

User Control: You have full control over camera permissions and may grant or deny access at any time through your browser or device settings.

No Background Access: The application does not access your camera in the background or without your explicit interaction.

Alternative Access: If you choose not to grant camera access, you may still use the service by manually entering or accessing the menu through alternative methods.

⚠️ Liability Disclaimer (Camera): We are not responsible for any device-level permissions, browser behavior, or operating system handling of camera access. Users are responsible for managing their device privacy settings.

🔐 Security Statement: We implement reasonable technical safeguards to ensure that camera access is used strictly for its intended purpose and cannot be misused within the application.

5. Uploaded Content and Intellectual Property

Restaurant owners are responsible for ensuring they have all required rights, permissions, and licenses for any text, images, menus, logos, trademarks, and other materials uploaded to the platform. We may remove or restrict content that appears unlawful, infringing, abusive, or incompatible with platform policy.

6. Third-Party Services

The platform may rely on third-party services such as Cloudflare, Google services, authentication providers, map links, analytics tools, hosting providers, and advertising technologies. We are not responsible for service interruptions, data handling practices, or policy changes of independent third-party services.

7. Service Availability

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not promise uninterrupted availability, error-free performance, or suitability for every legal or operational environment. Planned maintenance, third-party outages, network failures, abuse controls, and security interventions may affect access.

8. Suspension, Discontinuation, and Force Majeure

We reserve the right, at any time and in our sole discretion, to modify, suspend, limit, or discontinue all or part of the service, temporarily or permanently, with or without prior notice. This includes situations involving business decisions, technical limitations, infrastructure failures, third-party dependency issues, legal or regulatory changes, cost constraints, security risks, abuse, or circumstances beyond our reasonable control.

PleaseScanMenu will not be liable for any loss, interruption, business impact, or damage arising from the suspension, unavailability, degradation, or permanent discontinuation of the platform. Force majeure events may include, without limitation, natural disasters, war, civil unrest, labor disputes, government action, internet or hosting failures, power outages, cyber incidents, supplier failures, or other events outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, PleaseScanMenu will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, lost business, business interruption, lost data, reputational harm, or guest disputes arising from use of the platform. This includes issues related to restaurant content, QR materials, translation accuracy, menu errors, pricing errors, third-party outages, and operator misuse.

10. Indemnification

You agree to defend, indemnify, and hold PleaseScanMenu harmless from claims, losses, liabilities, and expenses, including reasonable legal fees, arising from your content, your misuse of the platform, your breach of these terms, or your violation of any law or third-party rights.
